Easel is committed to protecting your personal information. As
part of our commitment to your privacy, we have implemented this
Privacy Policy, which explains our privacy practices, including
those of the uneasel.com and easel.ca Web Sites (collectively, the
"Web Site"). We may change this Privacy Policy from time
to time to better serve your needs. Notice of any changes will be
provided on the Web Site.
1. What is "Personal Information"?
"Personal Information" is information about you that identifies
you as an individual. Examples include your name, mailing and e-mail
addresses, age, birthday telephone number, credit card data, picture
and voice recording. Your personal preferences, such as your favourite
music style, could also qualify as Personal Information if connected
with other information that identifies you. This Privacy Policy
describes the types of Personal Information that we collect, how
and why we collect it, what we use it for and with whom we share
it.
"Non-identifiable Information" is information that cannot
be associated with, or traced back to, a specific individual. Non-identifiable
Information includes: anonymous aggregated information, information
about your visits to the Web Site which is not linked to you, and
information about your computer's operating system and web browser
software. Your computer and its operating systems, browsers, and
memory contain vast quantities of transaction data and records of
your computer use. This information could be gleaned from these
systems by outsiders if you do not take steps to protect your system.
It is our policy not to associate this information with customers,
even though we verify some kinds of technical information to ensure
that the Web Site is optimized to serve our customers.
When you interact with the Web Site, we may use a browser feature,
known as a "cookie", to verify Non-identifiable Information
about visitors to the Web Site and measure visitor traffic patterns.
A cookie is a small computer file. When you first visit the Web
Site, the Web Site manager may have implemented a program that stores
a cookie on your computer's hard drive. On subsequent visits to
the Web Site, our server communicates with your computer, reads
the cookie, recognizes and confirms that you are a returning visitor.
Our server uses this information to provide you with a "short
cut" that facilitates the quickest, most efficient and best
possible Web Site experience. We do this to maintain the best possible
Web Site. We ensure that the minimum information required is placed
in the cookie only so that we can recognize returning Web Site visitors.
The cookie does not contain Personal Information and we will not
combine information in the cookie with Personal Information that
would enable us to identify you individually.
2. Collection of Personal Information
We collect Personal Information in order to provide services and
information to you. For example, data is collected in the following
ways:
- When you register to join Easel;
- When Artists submit content to Easel;
- When you subscribe to our e-mail newsletters;
- When you respond to online questionnaires;
- When you participate in interactive online activities (such
as chats, bulletin boards, etc.);
- When you shop online at the Web Site; or
- When you contact us to make requests or comment on our services.
We take particular care in the collection of Personal Information
from children. If you are under the age of eighteen (18) you may
not use Easel's services unless through the mediation of a parent
or legal guardian who agrees to be bound by Easel's Terms of Use
and this Privacy Policy. Easel does not intentionally collect personal
information about individuals under the age of eighteen (18).
3. Use and Disclosure of Personal Information
(a) Registration and Membership
Easel offers you the opportunity to register and become a member,
so that you can participate on a regular basis in services and activities
offered on the Web Site. We do collect Personal Information when
you join in accordance with the following principles:
- We collect only the information necessary for the services and
activities offered; and
- Access to our services and activities is never conditional upon
you providing more Personal Information than is necessary for
such services and activities.
Easel requires submission of valid credit card data on registration
to confirm that you are a legal entity, and to assist with administrative
matters on purchase, billing and delivery of gallery submissions.
(b) Gallery Submission
When Artists submit content to Easel, Artists are required to provide
the following mandatory Personal Information so that we can offer
our services to the public: Artist names, age, and genders, contact
information, and a biography. In collecting and using this Personal
Information, we always comply with the principles stated in subsection
(a) above.
(c) Newsletter Subscriptions
When you subscribe to our online newsletters, you are required to
provide the following mandatory Personal Information so that we can
deliver the newsletter to you electronically: your first name, e-mail
address and your province or state of residence (in the last case,
for statistical purposes only). Subscribers (and their parents or
guardians, where applicable) can cancel a newsletter at any time by
following the "unsubscribe" instructions at the bottom of
the newsletter or by using the information at the end of this Privacy
Policy. Personal Information is deleted from our database immediately
on receipt of denial of parental or guardian consent and when a subscriber
cancels its subscription.
(d) Online Questionnaires
From time to time, we may request your feedback on an activity, product
or service that we offer or provide or on content on the Web Site.
We ask for your name and e-mail address when you are providing us
with feedback so that we may reply to you, but you always have the
option of providing us the feedback without sharing this information.
(e) Other Online Activities
When you visit the Web Site and participate in other online activities,
we may collect information such as your name, nickname, age category,
preferences, opinions, etc. Whether or not you are required to become
a member of the Web Site to participate in these activities we always
comply with the principles stated in subsection (a) above with respect
to memberships and registration.
(f) Online Purchases
You must be 18 years of age or older to make an online purchase on
the Web Site. Our purchasing services collect only basic ordering
information, including your name and shipping address, telephone number
and e-mail address, and valid credit card data. This is for the sole
purposes of processing and delivering products or services that you
buy online. We do not share this information outside of Easel, except
with our approved agents, suppliers, and shippers who help us to process
your order, and the Artist who supplied the purchased gallery item.
All of our approved agents, suppliers, shippers, and Artists are required
to provide a level of privacy protection comparable to that provided
in this Policy and are not permitted to use your Personal Information
for any other purpose, such as to market to you.
(g) Contacting Customer Service
If you telephone, write or e-mail us to comment on one of our services
or our Web Site, we will retain the information for our records during
a certain period of time. Disclosure of your Personal Information
is voluntary in this circumstance.
4. Use
(a) Personal Information of Individuals other than Artists
We will not disclose your Personal Information to third parties,
other than as detailed above, unless required by law. We use your
Personal Information for internal purposes only. We do not sell,
rent or trade in Personal Information. Your consent to our use of
Personal Information can be withdrawn at any time by following the
directions at the end of this policy. We will obtain your consent
before using your Personal Information for any purpose other than
these above. Once your Personal Information is no longer required
for the purposes above, it will be deleted.
(b) Personal Information of Artists
We will not disclose the Personal Information of Artists to third
parties other than for internal purposes and as an integral aspect
of offering our services to the public and in performing our obligations
pursuant to the Rights Acquisition Agreement we agreed to when Artists
submit content to Easel. We do not sell, rent or trade in Artists'
Personal Information. An Artist's consent to our use of its Personal
Information can be withdrawn pursuant to the terms of the Rights
Acquisition Agreement and by following the directions at the end
of this policy. We will obtain the Artist's consent before using
its Personal Information for any purpose other than these above.
Once an Artist's Personal Information is no longer required for
the purposes above, it will be deleted.
(c) General
Easel may disclose any Personal Information we have about you (including
your identity) if we determine that such disclosure is necessary
in connection with any investigation or complaint regarding your
use of the Web Site, or to identify, contact or bring legal action
against someone who may be causing injury to or interference with
(either intentionally or unintentionally) Easel's rights or property,
or the rights or property of visitors to or users of the Web Site,
including Easel's customers and suppliers. Easel reserves the right
at all times to disclose any Personal Information that Easel deems
necessary to comply with any applicable law, regulation, legal process
or governmental request. Easel also may disclose your Personal Information
when Easel determines that applicable law requires or permits such
disclosure, including exchanging Personal Information with other
companies and organizations for fraud protection purposes.
5. Security and Safeguards
We know how important privacy is to you. That is why we protect
and safeguard your Personal Information. Our security policies govern
the protection of the information on our information systems, the
way we protect the Web Site from malicious attack, and the way in
which we dispose of information no longer needed.
Security on the Internet is a continuously evolving problem and
we hire experts who keep up with the latest trends. If you receive
any electronic communication which purports to be from Easel that
you have any questions or concerns about, please contact us. Spam,
improper use, and pirating of domain names and email addresses is
a growing problem, so we appreciate hearing about incidents in order
that we may investigate them and provide you the best customer service.
6. Accessing Your Personal Information
You have the right to access, verify and amend Personal Information
that we collect about you. To keep your Personal Information current,
you can amend inaccuracies and make corrections by contacting us
as described at the end of this Privacy Policy.
